These Terms of Service (hereinafter "Terms") govern the use of PhotoPoem (hereinafter "this app"). By using this app, you agree to these Terms.

2. Service Description

This app provides a service that generates poetry using AI (artificial intelligence) based on photos selected by users, allowing them to save and share the generated poetry.

Important: AI poetry generation is an automated process. We do not guarantee the quality, accuracy, or literary form (haiku, tanka, etc.) of the generated poetry.

3. Terms of Use

3.1 Age Restrictions

This app is intended for users aged 13 and above. Users under 13 may not use this app.

Users under 18 must obtain parental consent before using this app. By using this app, you represent and warrant that you meet this age requirement.

3.2 Data Storage

Important: Photo and poetry data created in this app are stored only on your device. They are not stored on our servers.

Deleting the app will completely remove all saved data. Data recovery is not possible, so we recommend backing up important data using sharing features beforehand.

3.3 Account Registration

This app can be used without account registration. However, anonymous usage data may be collected for the following purposes:

Ad delivery optimization (Google AdMob)
App usage analysis and improvement (Google Analytics)

3.4 AdMob Ad Display

This app displays ads through Google AdMob. Ad display supports the free provision of this app, and users are considered to have consented to ad display.

4. Prohibited Activities

Users may not engage in the following activities:

Using photos that infringe on others' copyright, portrait rights, or privacy rights
Using photos containing illegal, harmful, defamatory, obscene, or violent content
Inappropriate use of photos featuring minors
Reverse engineering, modification, reproduction, or redistribution of this app
Activities that interfere with the normal operation of this app
Fraudulent ad clicking or intentional manipulation of ad revenue
Use of automation tools or bots
Commercial use in large quantities (without prior permission)

5. Intellectual Property Rights

5.1 App Intellectual Property Rights

Intellectual property rights related to this app's software, design, content, and algorithms are owned by us.

5.2 Rights to Generated Poetry

Regarding copyright of AI-generated poetry, the following applies:

Users may freely use and share generated poetry
However, commercial use may require separate permission

6. Advertising Provisions

6.1 Ad Display

This app displays third-party ads through Google AdMob. We are not responsible for ad content.

6.2 Ad Policy

Users understand and agree to the following:

Ads display content appropriate for general users aged 13 and above
Fraudulent ad clicking is prohibited and may result in account suspension
Use of ad blockers may limit app functionality

7. Privacy and Data

For personal information handling, please refer to our Privacy Policy. This app targets users aged 13 and above and operates outside the scope of COPPA (Children's Online Privacy Protection Act).

8. Disclaimers

8.1 Service Provision

We do not guarantee the following:

Continuous provision of this app
Quality, content, or copyright issues of generated poetry
Temporary service suspension due to network failures or maintenance
Third-party ad content and advertiser services

8.2 Limitation of Damages

We are not liable for any damages arising from the use of this app. This includes but is not limited to:

Legal issues such as copyright infringement or defamation arising from the use of AI-generated poetry
Data loss due to app deletion or device failure
Issues with the quality or content of generated poetry
Disputes with third parties
Opportunity loss due to service suspension or feature limitations

9. Service Changes and Termination

We may change, suspend, or terminate this app without prior notice to users. In case of service termination, backup of locally stored data is the user's responsibility.

10. Changes to Terms

We may modify these Terms at any time.

11. Governing Law and Jurisdiction

These Terms are governed by Japanese law, and any disputes regarding these Terms shall be subject to the exclusive jurisdiction of the Osaka District Court as the court of first instance.
